  • William marbury was upset he wanted to be a judge so he asked the us supreme court to issue a legal order called a writ of mandamus. in 1789 congress passed a law the judiciary act of 1789 saying people could start if all they wanted was a writ of mandamus
  • Marshall turned down his claim. he said that the constitution did not give jurisdiction to decide marburys case therefore the supreme court said it could not help marbury get his commission
  • this was the first time that judicial review was used judicial review is the right of the supreme court
