Did you hear what happened?
October 18, 1975, Erwin Simants walked in the home of Henry Kellie, in Nebraska, raping and killing Henry's ten-year-old granddaughter.
When the Kellie family came home, they found Simant waiting. Killing Henry, Henry's wife, son and two other grandchildren
This is where the 1st amendment comes in.
Immediately the morning after, Simant was charged with six first degree murders. Televisions and new paper were posted everywhere with the horrific situation
This can't happen to everybody.
I know, this isn't going to.
The court issued a gag order because of the sensitive material in the case. And they wanted the case to be fair.
The judge said the freedom of the press and the right to fair trial are equally as important.
In conclusion, The judge issued a restraint to the media from publishing confessions to the police but, the chief justice said that the "whole community cannot be restrained from a subject affecting life within it."
