I do not agree with Hamilton, I will tell Madison to not send the commissions.
Section 13 of the Judiciary Act of 1789 gives the Supreme Court the power to require federal officials to fulfill their duties.
I want to agree with Marbury, but what if Madison ignores me, that will make the Supreme Court look weak.
Marbury will get his commission as long as Madison agrees. The Judiciary Act is unconstitutional so I cannot force Madison to send the commission.
