In an effort to avoid a crisis between the North and South the government created the Compromise of 1850. The federal government instated the fugitive slave act, and abolished the slave trade in D.C. As part of the compromise California joined the Union as a free state and Missouri joined as a slave state.
Between the years 1856 and 1857 Dred Scott sues his master for his freedom. His argument was that he was held illegally as a slave in a non-slave state, so he shouldn't have to be a slave anymore. He also sued for abuse. He lost the case.
However, since affairs between citizens of two different states take place in federal courts the case was reopened.The judge that ruled. Back when this case took place many judges and politicians had a strong opinion on slavery. Scott's case was a ruled by a southern judge, who didn't see slaves as US citizens. This resulted in Scott losing the case once again, and being ruled as Sanford's slave. (The clerk who funded the law suit added an extra later on accident. The case was from them on known as Dred Scott vs Sanford case)
