  • The year was 1801. John Adams' presidential term was about to end, and he wanted to stop the Democratic - Republicans by appointing Federalist judges for each district under the new Judiciary Act of 1801. One of these judges was William Marbury
  • William Marbury, I would like to appoint you to become a justice of the peace for the District of Columbia. You will be installed by James Madison.
  • Thanks John Adams! I would be honored to be a Supreme Court Justice.
  • No, I refuse!
  • WHAT?! I will sue you. I am going to make a case against you and we will go to court!
  • James Madison, I was appointed justice of peace and you are to install me into office
  • William Marbury, the law that you sued against is unconstitutional. It contradicts the Constitution!
  • What! How John Marshall!
  • Even though Marbury lost, it established the principle of judicial review. Judicial review is where the Supreme Court has the power to determine if actions by the executive and legislative branch are unconstitutional. This is very important to us today because it ensures that the are government is abiding to the laws.
