We have made a choice. In the case Gideon v. Wainwright Gideon wins
Clarence stole $5 and some drinks at a pool hall. He was arrested and was sent to court to be tried in front of a jury. While in jail he petitioned to the Supreme Court because his 6th amendment rights were violated. The Supreme Court took his case and his side. The 6th Amendment states that everyone has the right to a lawyer. Clarence was sent to a lower court and had a fair trial.
