  • John Adams: As President of the United States I nominate you to serve as Justice of Peace for District of Columbia.
  • William Marbury: It would be my honor to serve you sir, however your presidency is almost at an end.
  • John Adams: I would like you fine men to take positions in our government and deliver these commissions .
  • Yes Sir!
  • Thomas Jefferson: As new President of the United States I would like to make you Secretary of State.
  • James Madison: I would gladly serve as Secretary of State Mr President.
  • Thomas Jefferson: There are several documents left over from the previous presidency. You are not to deliver any of them. Am I understood?
  • Yes Sir!
  • William Marbury: I stand before the court today to ask that you you order the new secretary of state to deliver these commissions.
  • John Marshall: Under the Judiciary Act of 1789 Congress was given power to issue a Writ of Mandamus. This power conflicts with the Constitution.
