  • I'm sorry, but the job belongs to whoever Jefferson wants. The opinion of court ruled that the Judiciary Act of 1789 is unconstitutional.

  • The impact of this historical case is that it established Judicial Review. Judicial Review is the Supreme Court's power to declare a law unconstitutional. Therefore, William Marbury never became Justice of Peace because the Judiciary Act of 1789 was declared unconstitutional by the Supreme Court. The law Marbury used was that it was his legal right to take the job.
