Joe and Steve work for "Bob's window washing miracle". One day, they were called in for a job.
When they arrived to the building, Joe started to help steve put on the harness to climb up the building. It is Joe's duty of care to make sure that steve is safely in the harness.
But, Joe was in a major hurry because his wife was cooking a delicious dinner that Joe couldn't wait to eat. As a result, he knowingly left the harness loose (Strict Liability) so that Steve could hurriedly get the job done.
Breach of Duty: Joe knowing that a loose harness could result in major damages but letting it happen any way.
Proximate Cause: But for Joe letting Steve go knowing that the harness was loose and that it may cause injuries, Steve wouldn't have fallen and hurt himself severely.
Steve, thinking everything was okay, started making his way across each level, cleaning the windows. On the third story, one of the buckles on the harness comes undone because it was loose and Steve falls three stories.
Actual Harm: Steve ended up with both of his legs broken and a broken arm.
Steve is very mad at Joe for causing his injuries so he decides to sue.
Defense: Comparative neglignece. Joe will pay $25,000 whereas Steve will pay $10,000.
