  • In 1809, a dispute between John Peck and Robert Fletcher over the legal status of the land that Peck was selling began to escalate
  • b-b-but all the previous sales have been legal! i purchased it legally!
  • this isn't legally your land! you can't be selling it!!!
  • I'm telling you, I am purchasing and selling legally!
  • ...which ended in a trip to the Supreme Court
  • Yeah, yeah, buddy. That's what they all say. We'll let the judge settle THIS.
  • The land that was in my possession was attained legally and so I had the right to sell it 
  • Peck argued that ...
  • Since the land that Mr. Peck obtain was from an invalid legislative grant, when he sold me the land it was then a breach of our contract
  • While Fletcher argued that...
  • Since Georgia violated the contract clause when repealing the land grants, Fetcher can keep the land and Peck can keep the money.
  • Therefore, I declare the law caused Georgia to attempt to void the land, unconstitutional, and declare that contracts must not be rescinded.
  • These court rulings showcased the Supreme Court's ability to declare state laws unconstitutional, and established sanctity of contracts.
