The Supreme Court
I was not able to afford an attorney, therefore, I believe I was not given a fair trial which is against my 6th amendment right.
The Supreme Court has come to an unanimous decision, attorneys are needed in the court, even if the criminal can't afford it because they lack knowledge of defense for themselves. It has to be a fair trial.
January 15th, 1963. The case was brought to the Supreme Court on writ of certiorari. The question present is whether or not Mr. Gideon should be appointed an attorney.
Gideon argues that he is not getting his 6th amendment right and not being provided an attorney was the reason that was happening. He wanted an attorney to give him a fair trial.
The case ruled in favor of Gideon, 9-0. The court believed that to have a fair case they need attorneys. Later, he was tried again, and this time he was appointed an attorney.
