  • As it's my last night in office, I've decided to appoint 16 federalist judgeships. I know with their different oppinions from Jefferson, they'll make the Judiciary branch stronger.
  • William Marbury
  • Now I, James Madison, will choose the people to comission, and Marbury will not be comissioned.
  • James Madison
  • I don't have to!
  • I'm going to sue you because you won't deliver my comission it's against the Judiciary act of 1789 for you not to.
  • Marbury
  • John Marshall, can I be awarded a Writ of Mandamus so Madison has to deliver my comission?
  • If the court awards you a Writ of Mandamus, it will most likley be ignored by Jefferson.
  • Also, the part of the Judiciary act of 1789 you are referring to is unconstitutional. The constitution has not forseen what is being assigned to supreme court powers.
  • Even though I was not given the comission, Marshall set the foundations for the powers of the Supreme Court.
