Storyboard Text

  • Well, tonight is my last night in office. Lets go out with a bang!!
  • John Adams
  • Yes Sir!!
  • James Madison
  • I see what John Adams was doing!! He was going to appoint a whole bunch of officials to have people from his party go into office! This will not work! Madison hold any commissions that have not delivered!
  • Thomas Jefferson
  • William Marbury
  • John Adams promised me this job! Thomas Jefferson can not do this! But James Madison is holding it, so I'll take him to the Supreme Court. I might have a better chance of winning.
  • Chief Justice John Marshall
  • I'm filing a writ of Mandamus for the commissions to be sent to Senate to get approved for my job.
  • The opinion of the court is that we agree that the commissions should go through, but we do not hold the power to issue a writ of Mandamus.
  • I thought you had the power since it was stated in the Judiciary Act of 1789?
  • Well, it did give me that power. But, it is ruled unconstitutional, because it violates article 3 section 2 of the Constitution.
  • This court case gave courts the right review acts of other branches of governments and the states. Which is also called judicial review.
