John Adams made many federalist appointments for justice of peace
One of those men was William Marbury
Jefferson refused to see Marbury, so Madison did not deliver the notice. This broke the Judiciary Act of 1789.
With Marbury very angry he decided to sue Madison even though Jefferson refused the appointment not Madison.
The Supreme Court took the case and the chief Justice wrote that the Judiciary act of 1798, which forced all commissions to be delivered, unconstitutional.
The court ruled the Judiciary Act of 1789 illegal and not to be followed. The case was dismissed and Marbury went home empty handed.
