Let me think... I declare as Chief Justice that the Judiciary Act of 1789 is indeed unconstitutional, and therefore I cannot order you to deliver these letters.
This declaration established the power of Judicial review. This power allows the Supreme Court to ensure that all laws remain constitutional. So, although Jefferson did not have to deliver the letter, he had to deal with Judicial review. Judicial review would continue to become the final check/balance in the US Government system, allowing the Supreme Court to also check laws, not just the President and Legislative branches.
