In Marbury v. Madison 1803 the Supreme Court announced for the first time the principle that a court may declare an act of Congress void if it is not consistent with the Constitution.
William Marbury had been appointed a justice of the peace for the District of Columbia in the final hours of the Adams administration. When James Madison, Thomas Jefferson’s secretary of state, didn't want to to deliver Marbury’s commission, He joined 3 other similar situations
The Marbury Vs. Madison decision expanded the power of the Supreme Court in general, by announcing that the 1789 law which gave the Court authority in this case was unconstitutional. Marbury though lost his case, which the Court said he should have won but, in explaining its inability to provide Marbury the treatment it said he deserved, the Court established the principle of judicial review.
