A short, simple storyboard to explain how judicial review was created from the case of Marbury vs Madison.
John Adams: Hey, William Marbury, I want you to be a Justice of the Peace.
Thomas Jefferson is elected President.
Thomas Jefferson: Now that the election is over, the Democratic-Republicans shall dominate the government!
James Madison: Oh that John Adams still wants Marbury as Justice of the Peace for the District of Columbia? I think we should change that bad decision...
(After James Madison, Secretary of State refuses to accept Marbury as JP)
William Marbury: How dare that James Madison refuse me, I shall take this to court!
John Marshall: After much thinking, it seems that the Judicial Act of 1789 is unconstitutional as it gives power denied by the Constitution, so we shall not follow it
Yes, the Supreme Court has denied Marbury's petition, and now they've started using the idea of Judicial Review. This is interesting, as I've never seen the Supreme Court strike down a law.
