A New York state law gave indivuals the exclusive right to operate steamboats on waters within State Jurisdiction. Routes all through the day were common. In this case Thomas Gibbons challenged the monopoly license granted by New York to Aaron Ogden.
Thomas Gibbons, Feburary 1, 1824.
Why is this fool taking not only my passengers but also my route?
Aaron Ogden, Feburary 1, 1824.
Right this way people, we don't have all day
Sir, are you aware that this is my route? And those, my passengers. Who and why are you here on this date.
Sorry sir, I am Aaron Ogden, but this is my route and these are my passengers, maybe you've got mixed up? The state of New York gave me a license, and now I run this route.
And I am Thomas Gibbons. The federal governement gave me this line.
This is an outrage! I'm going to sue New York for this.
A few days pass, and the arguement didn't get any better. So Gibbons took the problem to court to figure out a compromise.
