Cherokee Indians v. Georgia
Okay, so how did the Cherokee react to these laws?
In defense, they brought up the treaties they signed where they were labeled free and independant.
After failed negotiation with President Andrew & Congress, The Cherokee, with the help of John Ross, sought an injuction.
Did they win?
Well the Court began to see them as independant nations but since they were an Indian Nation they weren't counted as a foreign nation.
Since Indian Nation weren't mentioned in the Constitution, the Supreme Court dismissed the case.
That's unfair though, they should be treated the same!
The Chief Justice Marshall stated that they bestowed their upmost attention to the case and came to the conclusion that they were not a foreign nation.
President Andrew Jackson right?
Well, after a year in the Worcester v. Georgia they named the Cherokee a Sovereign Nation. Making the Indian Removale invalid but that didn't stop Jackson.
