- The sites significance is associated with the presence of different gods like Wao Akua (the creator), Na Akua (divine deities), and Papa (the earth mother). All these gods belonged to the traditional Hawaii groups. Mauna Kea has the embodiment of ancestors belonging to Hawaii tribes.
- Mauna Kea has a lot of significance to the local Hawaii people. Also, it holds cultural and religious significance. It's the region where local Hawaiians have their ancestral connections.

- Undue burden involves the restricions established by the government towards accessing a given resource, in this case, the Mauna Kea sacred site.
- However, governments efforts have prompted to the situation of undue burden facing the sacred site.
- Although Mauna Kea defines the religious significance of the Hawaiians, the ongoing land disputes prompted the establishment of restrictions.
- After Hawaii was annexed by the United States in 1959, most of the land titles with conflicts were surrendered to the U.S authorities for public trust. The Mauna Kea was among the lands whose titles were ceded to the U.S government.
- How does undue burden relate to the site?
- The local Hawaiians accused the government of robbing them their land, which is right since the Establishment Clause prevents such actions. Nevertheless, justice has not been done despite the abuse of cultural and religious practice rights as per the U.S constitution.
- Now that the U.S government is incharge of managing the land, they awarded the University of Hawaii an opportunity to build an astronomic site on it. As such, the local people of Hawaii with ancestral connections to the land became angry.
- The U.S judicial system was not fair to award the University of Hawaii go ahead to build the telescopes without engaging public opinion. Locals with ancestral connection on the land should have been engaged.
