  • The case that will be presented is Eisentadt v. Baird
  • This is William Baird. He would give away Emko Vaginal Foam to woman that were in Boston University. He also gave lecture on birth control and overpopulation.
  • At the time the law only allowed married couples to obtain contraceptives. They also only allowed registered doctors and pharmacists to provide and dispute the contraceptions. Baird was not even an authorized person to be giving the contraceptives away.
  • Then not too long later the state of Massachusetts had charged Baird with a felony. All because he had distributed contraceptives to unmarried men and woman.
  • This case ended up in the Supreme Court and was argued on November 17, 1971. The Constitutional issue that was present in the court was " Did the Massachusetts law violate the right to privacy acknowledge in Griswold v. Connecticut and protected from state intrusion by the Fourteenth Amendment?"
  • The Supreme Court decided on March 22, 1972 and ruled 6 to 1 in favor of Baird. They stated, "It's the right of an individual, married or single, to be free from unwarranted governmental intrusion into matters so fundamentally affecting a person as the decision wether to bear or beget a child."
  • The impact this case Eisenstadt v. Baird had on America changed the way the United states worked. This case opened the door to men and woman to have the right to o obtain birth-control if there are not married. Giving them the choice to connive or not. And including the choose to their own body.
