- Hey Dad, will you tell me about the Gideon V. Wainwright case?
- It all started when Gideon got in big trouble but he couldn't afford an attorney to represent him.
- Oh no... let's keep walking and you can tell me both sides of the case.
- Basically, the Supreme Court ruled that some of the constitutional rights only protected people from the infringement by the federal government.
- What was Gideon's side of the case?
- Gideon argued that fair trials cannot be assured unless everyone has the assistance of a lawyer. The average person does not have the knowledge, resources, and skill required to provide an adequate legal defense for themself.
- Well, the right to have a free lawyer provided by the government has even become part of the Miranda warnings given to those arrested by the police
- No way! So what was the final decision?
