- Events - John Adams appointed federalist judges in supreme court before leaving office. One of them, William Marbury, a spot in the Supreme Court. Shortly after Jefferson arrived in office and paused the commissions.
- Voted
- Events - Marbury did not receive the commission for the position and he was angered. He sued James Madison in the Supreme Court. Chief Justice Marshall agreed Marbury had the right to the commission.
- Gimmie the commission!!!
- Events - After judicial review, Marshall said it would go against section 13 of the Constitution to force Madison to give up the commission. Therefore Marbury did not get his commission.
- Sorry Marbury, nothing we can do. Sticking to the constitution.

- Impact - After judiciary review James Marshall says the Supreme Court doesn't have the jurisdiction.
- We cant do anything, the constitution is the supreme law of the land
- Impact - The Supreme court is then equal to both other branches of government
- Equal to and independent of congress and the executive branch
- Decision - Supreme court doesn't have enough power to force Madison to hand over the commission
