  • As elementary school staff members, it is important that you understand what IDEA is, the specifics, and how to support your students and families. It's also important you stay ethical, respectful, and create a supportive environment for all.

  • Overview of IDEA
  • IDEA protects students ages 2-21. It ensures they are provided with FAPE and LRE. It also protects the rights of students, parents, and makes sure that educators and parents have the tools needed to help improve a child's educational outcome. It also assists states in the implementation of comprehensive and early intervention services for infants and toddlers, and helps provide education for all children with disabilities
  • The Individuals with Disabilities Education Act is a legally binding mandate. It's important you understand it for legal compliance, IEP implementation, inclusion, and early intervention.

  • Effects of the law on individuals, guardians, and educational organizations
  • IDEA has had many positive effects on all involved parties. Of course, everything has a negative side as well, but if this law is getting us taking and focused on how we can help our SWD, then that is what's important!
  • Students- ensures FAPE, provides an IEP tailored to their needs/goals, encourages inclusion, and helps students self-advocate. Sometimes IDEA and inclusion can lead to being anxious, and IEPS can sometimes lead to what a child "cannot" do. Guardians- gives them legal rights, procedural safe-guards, helps with early interventions, and provides evaluations at no cost. IDEA can help them feel more involved in the process and decision making for their student, and feel closer to the school.Educational Organizations- dictates trainings, provides funding, lays out procedures, encourages data driven decision making, and helps schools comply with the state mandates.

  • What are the benefits of IDEA?
  • -FAPE-LRE-Early Intervention-Procedural Safeguards for student and families-Increases the likelihood of graduation for SWD-Fosters strong relationships with families-Empowers Students with Disabilities (SWD)
  • FAPE guarantees students in special education receive public education services for free. LRE ensures that SWD are educated with their non-disabled peers as often as possible. Early Intervention is provided for students ages birth-3 and can help diagnose students as developmentally delayed. They also offer "Child Find", a program to assist parents and guardians with finding early resources. Procedural safeguards lay out everything the parents/guardians need to know while navigating the process and paperwork. Because of IDEA, graduation rates for SWD have gone up 32.9 points in Florida since 2005.

  • Limitations of IDEA
  • Yes, there are limitations to IDEA. The NCD has a great article that describes some of those limitations and how to fix them. 
  • All of those benefits sound great, but are there any pitfalls or limitations of IDEA?
  • Some limitations include: underfunding, implementation gaps, and resource disparities. The NCD also describes discrepancies with the zero-reject principle, where some schools try to suspend or possibly expel students for behavioral issues or special challenges without following protocol. Some schools also fall short of providing students with the correct LRE and/or services. In addition, even though there is an IEP team, professionals often make the choices, and parents might not feel heard or have their concerns dismissed (NCD, 1996).

  • Yes, there is an "Introduction to IDEA course" created by the Progress Center that will take you about 30 minutes and provides a great overview.

  • I'm still a little unsure about the differences between FAPE and LRE. I want to gain a better understanding. Any suggestions?
  • The Individuals With Disabilities Education Act: Clarifying the Relationship Between FAPE and LRE written in 2025 is a great resource!
  • This article discusses how some parties believe that FAPE and LRE don't go along with each other, but Yell and Bradley (2025) disagree. It also summarized high and low incidence disabilities and how it is important to provide interventions for each individual child, not an intervention for a specific disability. This article also includes examples of court cases that have to do with LRE and FAPE. They're great law examples for what to do and not to do.

  • There's also a great handout of tips for proper implementation of IDEA created by the NEA. It's a great resource to keep with your planning materials.

  • Navigating the world of students with disabilities can be off putting and scary. It's our job to make sure we are helping our families navigate the process. What resources do you think we could use to do this?
  • What about the IDEA website?
  • The federal government created an IDEA website with lots of links and information. This is a great site to bookmark and review when you have questions as an educator, but it also has links specific for families to find trainings, resources, and definitions. https://sites.ed.gov/idea/parents-families/

  • Yes! It is a Florida based transition Education Network that assists schools and families with services to help students be successful as they transfer out of school.
  • I heard about an organization called Project 10 that can help SWD transition into adulthood.
  • Project 10 is an IDEA funded state project in Florida that provides resources to families, students, educators, and more. It's goal is to help SWD successfully transfer from school to the "real world. It helps with job and home placements, postsecondary education, legal help, and more!https://project10.info/about.php?ID=

  • The Center for Parent Information and Resources has a great landing page with tons of links to help parents/guardians navigate the world of IDEA and SWD.
  • The Center for Parent Information and Services has links to Parental Rights under IDEA, defines terms, lays out the steps for evaluations, explains key elements of IEPS, provides ideas for addressing behavior issues, recommends accommodations, and more!https://www.parentcenterhub.org/schoolage/

  • Demonstrate personal character, virtuous actions, and respect diversity
  • We are role models and should always demonstrate personal character and virtue. It's important to show genuine care for our students, have a growth mindset, know and understand the law, lead by example with students and their families, and be good role models. If we make a mistake, we need to acknowledge it and fix it. Most importantly, we need our families to know they are part of the team, and we need them.

  • It's also important to treat students as more than just their disability. We need to respect their culture and their families beliefs about education. You should make sure to use district approved inclusive materials and work cooperatively with all team members. Regardless of a students disability, we need to make sure to discipline fairly. As role models in our school, we need to cultivate cultural awareness and set the example.
