  • Next is the senate judiciary committee vote, however, despite if they oppose the nominee, it is customary for the committee to send the nomination to the rest of the Senate for debate.
  • The Senate then opens the floor for debate. At this point, a judicial nomination could go down one of two roads, confirmation, or declination.
  • Let's Explore what could potentially go wrong down the road, and cause a nominee not to be confirmed...
  • There has to be a 60 votes to STOP the Filibuster If there isn't enough votes to stop the filibuster, the nomination fails :(
  • Oh no! A Filibuster!! What happens if a senator stalls the debate by not giving up the floor?
  • BUT...
  • If 60 votes are granted, then the nomination is voted on, and a 51 majority vote will confirm the nominee! :)
  • Other problems that may arise... BORKING
  • This is the process where senators and/or interest groups make the hearing process very public and political, often making the nominee seem extreme or untruthful, in an attempt to get the nominee rejected.
