Defense: In capital cases an attorney is provided, and neither the 6th nor the 14th amendments differentiate between the types of cases.
During Betts v. Brady fewer than half of the states required appointed counsel, but during Gideons arrest 45 did.
Plus taxes would rise if everyone was appointed counsel, and it's still possible to have a fair trial if many judges are involved.
Okay, but Betts v. Brady is only 21 years old and ruled that counsel is only provided under special circumstances.
