Judiciary Act of 1801 has been repealed!
One of the first acts of the new administration was to repeal the Judiciary Act of 1801, which allowed a number of new judgeships. This means that it would likely cause loss of judgeships created under the act, a restructuring of the federal courts, and a political move to counterbalance the influence of the previous administration.

After President Adams attempted to fill empty spaces before the end of his term, a number of commissions were not received. This left one of the appointees, William Marbury, to sue the Secretary of State, James Madison, and force him to fulfill his responsibility/duty as a Secretary of State.

Leaving the new chief justice, John Marshall, to understand that if the Court gave Marbury a forceful order to Madison, the Jefferson administration would ignore it, weakening the authority of the courts. But, if the Court denied the writ, it may appear that the justices had acted out of panic. Leaving either case to be the highest authority in society and ensuring that nobody is above the law.
