Yes, this regards the 8th amendment of the US Constitution, which discusses the Cruel and Unusual Punishment Clause, stating that any cruel and unusual punishment is to be prohibited.
I didn't know this era was so involved with the way we live today. I have also heard about an enlightenment thinker who helped bring about restrictions to punishment that we live by today.

This idea was first brought up by an Enlightenment thinker known as Cesare Bonesana di Beccaria. He stated every individual should have dignity in the criminal justice system. He disapproved of punishment and torture as he stated it could lead to anarchy or citizen rebellion towards the government.
