  • Using the reasoning from the Atkins vs Virginia case and the writ of Certiorari, they began questioning the ruling of the Roper vs Simmons case. 
  • He was only a minor, maybe my judgment was to harsh? Does that mean I violated the 8th and 14th amendment?

  • Multiple amicus curiae briefs were filed to influence the court, many being neurological studies of brain immaturity. This and other oral arguments from Simmons side claimed that banning the death penalty would promote evolving societal standards.

  • On appeal to the supreme court, the opinion of the court( being the dissenting opinion.) was rapidly siding with the "evolving standards"( ending up to be the concurring opinion.) argument being to dangerous because state courts could very easily say that were now allowed due to a change in belief in the people of the state. However it was eventually decided the execution of minors did indeed violate the 8th and 14th amendment.
