Leaving the new chief justice, John Marshall, to understand that if the Court gave Marbury a forceful order to Madison, the Jefferson administration would ignore it, weakening the authority of the courts. But, if the Court denied the writ, it may appear that the justices had acted out of panic. Leaving either case to be the highest authority in society and ensuring that nobody is above the law.
