Storyboard Description

This story is about a gang that murdered a boy by first planning it, then shooting him. Soon after they leave, a woman comes by. The woman notices that body and was terrified. She was also unsure whether the boy was dead or alive. She didn't know whether to help him or just leave. She knew that the police would be arriving soon and didn't want to be considered an accomplice. She quickly comes up with the idea to hide the body. This is an example of willful blindness. Wilful blindness refers to the accused's mental state. It refers to a circumstance in which someone tries to avoid criminal accountability by obfuscating the obvious. This woman tried to avoid being called an accomplice by hiding the body. This story shows Actus Reus when the woman physically moves the body. This is a called a 'guilty act', this was a voluntary and physical action that was made by the defendant. This story shows men's rea when the woman decided to hide the body so she wouldn't be an accomplice. This is called a 'guilty mind' She knew that the police were going to look for the body, but she still decided to move and hide it. This type of men's rea is foreseeable and reckless as she knew the consequences and risks of committing the crime and still did it. The criminal charges that the gang would face are First Degree Murder, "Murder is first degree murder when it is planned and deliberate" R.S., 1985, c. C-46, s. 2292019, c. 25, s. 77 and Culpable Homicide. "A person commits culpable homicide when he causes the death of a human being, (a) by means of an unlawful act" R.S., c. C-34, s. 205 The criminal charge that the woman would be charged with is Nuisances Dead body." Every person is guilty of an indictable offence and liable to imprisonment for a term of not more than five years or is guilty of an offence punishable on summary conviction who (b) improperly or indecently interferes with or offers any indignity to a dead human body or human remains, whether buried or not.
