  • William Maybury: I was appointed to be the Justice of Peace in Washington D.C. You must deliver my commission so I can be instated.
  • James Madison: I refuse to send the documents!
  • Madison must send the documents to validate my commission.
  • I demand that a writ of mandamus be issued so that Maybury will deliver the documents.
  • Maybury v. Madison (1803)
  • It has been decided that Maybury must send the documents but a writ of mandamus will not be issued.

  • It has also been decided that the Judiciary Act of 1789 what allowed Maybury to petition the court is unconstitutional because it interferes with what is written in the Constitution.

  • Maybury v. Madison was significant because it established the process of judicial review. This is the process of deciding whether or not a law is constitutional. The Supreme Court found that a law perviously written interfered with the powers given to the Supreme Court by the Constitution. The Supreme Court decided that the law was unconstitutional and nullified it. Although Maybury was entitled to receive his documents, the Supreme Court was unable to act because of the conflicting laws.
