Charles Schenck was a socialist who opposed the war and he passed out leaflets to resist the draft.
Charles Schenck was then arrested and convicted of violating the Sedition Act by interfering with recruitment.
The Supreme Court determined that his first amendment right of free speech was not violated as he put America in "clear and present danger". The Supreme Court determined that in time of war freedom of speech can be restricted.
