Texas v. Johnson 491 U.S. 397
The year is 1989 and Ronald Reagan is currently the president of the United States. There is a National Republican Convention being held in Dallas, Texas. Johnson, in form of a protest, burned a flag.
Gregory Lee Johnson burned the American flag outside of a Republican meeting to protest Reagan's policies.
Issue: The issue was that since Johnson burned a flag, was this violating any laws? Did this go against the first amendment?
The constitutional issue involved the first amendment. freedom of speech and protest The court ruled 5:4 that Johnson did not do anything wrong because he was protesting. This makes this a landmark case.
