  • Before Adams left office, he had written commissions to fill the empty judges in office. They weren't delivered. It was up to Thomas Jefferson on what to do.
  • James Madison, please take these and DON'T deliver them.
  • Okay Mr. President.
  • William Marbury was NOT happy. Without his comission he couldn't have his job. He sued Jefferson , and it was up to Chief Justice Marshall whether he could or not.
  • I am taking this to the supreme court and suing Thomas Jefferson!
  • If the court makes Madison deliever the comissions, the Jefferson Adminastation could ignore it and make the courts look weak.
  • Chief Justice Marshall was in a dilemma on what he should do.
  • And if the Court denies the writ, it could look like they are cowards and acted out of fear!
  • I have decided that Madison should have sent the commissions, but I have no jurisdiction because of the constitutional and I deem this unconstitutional.
  • The judiciary act that gave the supreme court the power to order a decision exceeded the authority to grant the court under article 111 of the constitution. It  was therefore invalid and Marhsall was able to create a situation where the court would be denied.
  • In the end it showed the Supreme Court has the power to determine whether a law is constitutional or not.
