Dred Scott was born as a slave in the south. His owner was an army doctor who moved often, sometimes to the north.

The court ruled that not only slaves were in fact property and could not sue, but slaves could not be outlawed due to the 5th amendment proclaiming that state laws could not take away property from citizens.
