  • When Edie Windsors wife Thea Spyer died, the federal government refused to recognize their marriage and taxed Edie´s inheritance from Thea.
  • Supreme Court´s Ruling
  • DOMA(defense of Marriage Act) violates the equal protection principles of the U.S constitution because it recognizes heterosexual couples, but not same sex couples. Also that this taxation on the inheritance violates the 5th Amendment.

  • DOMA is constitutional and the law should undergo minimal security under a rational basis test because sexual orientation is not a historically protected class.
