Ok I guess I'll appoint them.
I, William Marbury, will sue Secretary of state James Madison for forcing me to deliver my commission as justice of peace.
I understand if they award Marbury a writ of mandamus the Jefferson administration will ignore it.
I declare that Madison should have delivered the commission to Marbury and that the section of the Judiciary Act of 1789 that gave the Supreme Court the power to issue writs of mandamus exceeded the authority of the Constitution.
