Judiciary Act of 1789
John Adams appointed Marbury to be Justice of Peace however this was at the end of his term as president causing Marbury to wait for his papers.
Thomas Jefferson became the next president and told his secretary of state James Madison to not give Marbury his J.O.P. appointment papers.
Do not let him have the papers!!!!
Marbury asked the Supreme Court to enforce Madison to deliver the papers using the Judiciary Act.
Marbury had the right to his papers, but never got them because the SC declared the Judiciary Act of 1789 unconstitutional.
The SC had the power of Judicial Review to use the act for the 1st time so Marbury never got his job or papers.
