Before Jackson's time, the U.S. and Indian tribes had created treaties regarding the land that belongs to the Natives. According to these treaties, the U.S. can not mess with the Native's land because they are a completely different nation.
Indian Removal Act
At the time that Jackson was in office, the Natives had already set up a society. They had their own Constitution and government as well as farms and cattle. Some of the wealthier natives had slaves that would work in their fields.
Worcester v. Georgia Supreme Cort Case
The people of Georgia find gold in the land of the Cherokee and they want the gold for themselves so they confront Congress and the government to let them have access to the land and to push the natives off of it.
Trail of Tears & Indian Territory
After arguments but finally with consent from Congress Jackson sines, the Indian Removal Act which is a law that states that the Natives should be kicked off their land and should live in Indian Territory (also known as Oklahoma).
The Cherokee brought up this case to the Supreme Court when they heard about the Indian Removal and act and the Supreme Court voted in favor of letting the Indians have their land back because of the previous treaties.
Furious about the Supreme Courts ruling Jackson orders the military to drive the Indians out at gunpoint all the way from Georgia to Oklahoma with nothing but the clothes on their backs. Altogether, 70,000 people died.
