  • Jefferson won the 1800 election and this led up to the court case because he would cause issues with Marbury.
  • When Madison wants to know whether or not to pay/appoint Marbury Jefferson tells him not too. Which will make Marbury mad as you will see later.
  • No don't pay Marbury 
  • So should we pay Marbury?
  • When Marbury realizes he will not get payed he gets angry. He then files a law suit that the supreme court is gonna hear. What he wants is a writ. A writ is to enforce something like why was he not getting payed
  • Oh their not gonna pay me then I'm gonna file a law suit to make me a writ to the supreme court.
  • Marshall said that Marbury should get paid, but they did not have the power to enforce that. So the decision was that Marbury would not get appointed or paid because of this.
  • We have decided that we cannot do this because of a judiciary act of 1789. It would be unconstitutional and we do not have the power to enforce them to appoint or pay you
  • Sorry?
  • After the decision was made Marshall yelled at Jefferson for what he did.
  • You are not allowed to do that. You realize the position you put us in. (More Yelling)
  • After this court case the judicial branch was finally viewed as an equal branch to everyone else. This is because it showed checks and balances based of the constitution and not being unconstitutional.
  • The judiciary branch is finally equal in power. Yay!
