  • Did you hear what happened?
  • October 18, 1975, Erwin Simants walked in the home of Henry Kellie, in Nebraska, raping and killing Henry's ten-year-old granddaughter.
  • When the Kellie family came home, they found Simant waiting. Killing Henry, Henry's wife, son and two other grandchildren
  • This is where the 1st amendment comes in.
  • Immediately the morning after, Simant was charged with six first degree murders. Televisions and new paper were posted everywhere with the horrific situation
  • This can't happen to everybody.
  • I know, this isn't going to.
  • The court issued a gag order because of the sensitive material in the case. And they wanted the case to be fair.
  • The judge said the freedom of the press and the right to fair trial are equally as important.
  • In conclusion, The judge issued a restraint to the media from publishing confessions to the police but, the chief justice said that the "whole community cannot be restrained from a subject affecting life within it."
