  • Yes. Both of those have occurred. Some have resulted in a criminal indictment. Once in a while, there is an acquittal. 
  • Are there ever any cases where staff members commit a felony or misdemeanor? 
  • Moral turpitude? What's that mean?
  • That's correct! 
  • Usually the cases of criminal indictment are the result of moral turpitude. 
  • That's where someone has engaged in behavior considered cruel, treacherous, abhorrent, or depraved. 
  • Is it possible for schools to fire people for cohabitation or health issues such as obesity? I heard some school tried that. 
  • No, the Equal Protection Clause is part of the 14th Amendment. It ensures that everyone within its jurisdiction has equal protection from the law. Plus, health issues that I think are something that everyone has to deal with at some point in their lives. 
  • As long as a school makes adjustments necessary to help its staff and students, that is considered reasonable care. 
  • How about if a school is unable or unwilling to provide reasonable care? 
  • You mean age discrimination actually occurs!?
  • Yeah, one of the teachers at the school is one that was targeted. 
  • Could you touch base on ADEA? I think we all heard about the district that tried to find cause to fire all of its elderly teachers. 
  • ADEA stands for Age Discrimination in Employment Act. It was put into place to promote employment of older individuals. It is based on their ability and is to eliminate age discrimination. 
  • Thank you for coming today! 
  • I think this talk today has been beneficial for us. We got to learn about a few things going on especially in our area of the state. 
  • It's always nice to hear and talk about these issues even if it is a refresher.
