  • As James Adams' last action as president, he appointed many "midnight judges" for the next president to approve. One of these midnight judges was William Marbury.
  • Your honor, these men acted illegally by not giving me the commissions to become judge and I will trust that you will preform your official duties as stated in the Judicial Act of 1789
  • James Madison, make sure not to send these appointments to the commission.

  • It looks like Madison and Jefferson had won the case, but this case was something America will not forget. This case introduced the idea of Judicial review where gave the Supreme Court power to decide whether a law or bill is constitutional, strengthening the system of checks and balances
