When Dred Scott’s owner John Emmerson died, Emmerson’s wife sent Dred Scott’s children to a plantation to work in the fields.
After Dred Scott’s children were sent to the south, Dred Scott became angry and took his case to court to defend himself as a U.S citizen and get his children back. Scott believed because he lived in a free state that he should be considered a free citizen.
Because there were so many arguments in court and so many delays, Dred Scott’s case was in court for 10 years.
The case between Dred Scott and Emmerson’s wife drug on so long that the judge decided to send the case to the Supreme Court. Unfortunately Scott lost his case because Emmersons lawyer argued that because Scott was a slave he should not have been able to go to court at all.
The result of the case made Southerners happy because they felt their rights as slave owners were protected. While Northerners were angry and scared that Congress might make all free states into slave states. This story was one of the things that made people want to abolish slavery all together and utimatly cause the Civil War.
