Marbury got so upset because he couldn't be a judge that he went to the Supreme court. In 1789 Congress passed the Judiciary act of 1789. Stating that others could begin at the supreme court if only they wanted to write a Mandamus.
Marbury's request was turned down by Marshall and stated that the Constitution didn't give the Supreme Court the authority to work on the case
