  • Wait! I don't want a lot of Federalist judges on the Supreme Court, especially Marbury for Justice of Peace!
  • I declare that Madison's act of not granting commission to Marbury, is indeed unconstitutional.
  • Before Jefferson's presidency starts...

  • Me either!! I'm gonna refuse to give Marbury the commission!

  • That doesn't seem fair that Madison is refusing to allow me to be Justice of Peace! I'm gonna take him to court!

  • It's not fair that I'm not Justice of Peace!

  • So now we turn to the Judiciary Act of 1789, and declare Marbury's act unconstitutional!

  • However, the court does not have the power to issue a mandatory mandamus on Madison & Jefferson.

  • This court case helped establish Judicial Review, which allows The Supreme Court the deem a act of Congress or law unconstitutional. Judicial Review is now considered one of the foundations of the US Constitutional law.
