Wait! I don't want a lot of Federalist judges on the Supreme Court, especially Marbury for Justice of Peace!
I declare that Madison's act of not granting commission to Marbury, is indeed unconstitutional.
Before Jefferson's presidency starts...
Me either!! I'm gonna refuse to give Marbury the commission!
That doesn't seem fair that Madison is refusing to allow me to be Justice of Peace! I'm gonna take him to court!
I don't want Marbury to be Justice of Peace!
It's not fair that I'm not Justice of Peace!
So now we turn to the Judiciary Act of 1789, and declare Marbury's act unconstitutional!
However, the court does not have the power to issue a mandatory mandamus on Madison & Jefferson.
This court case helped establish Judicial Review, which allows The Supreme Court the deem a act of Congress or law unconstitutional. Judicial Review is now considered one of the foundations of the US Constitutional law.
