A few days before any acts were made, some teachers at Tinker's school heard rumors of the protest and banned black bands from the school.
When Tinker and a few of er friends actually wore the lack bands to her school, they were suspended from school until they took the bands off.
Tinker sued the school because the had violated her right to express what she believes in.

Tinker!!! They sided with Tinker because she was not disrespecting anyone or disrupting class and the first amendment protects our rights as american citizens that we may stand up for what we believe in and we have the freedom of speech.
