Justice Anthony M. Kennedy delivered the verdict of 5-4. The Court said that the Due Process Clause of the Fourteenth Amendment guarantees the right to marry. This analysis applies to same-sex couples in the same manner as it does to opposite-sex couples.

Some same-sex couples sued Ohio, Michigan, Kentucky, and Tennessee to show the constitutionality of those states' bans on same-sex marriage that occurred in jurisdictions that provided for such marriages.
The plaintiffs argued that the states' violated the Equal Protection Clause and Due Process Clause of the Fourteenth Amendment.
