Gibbons was taking business from ogden, and ogden claimed to be the origional holder of the franchise
Free trade was seriously threatened, The monopolies has lots of lawsuits trying to declare the agreement unconstitutional
Side A says that he has the original franchise making Gibbons the only man that could operate the steamboats
Side B argued that the government has the right to regulate interstate commerce but it doesn't apply to him because he is only in one state
Court ruled in favor of Gibbons
